Terms of Service

These Terms of Service (the Terms) are a binding agreement between you and GoldenCircle (referred to here as GoldenCircle, we, us, or our) and govern your use of our website, web application, and mobile and desktop apps (together, the Service). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. By using GoldenCircle, you confirm that you are 13 or older. If you are under the age of majority where you live, you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf. If you use the Service for an organization, you confirm that you are authorized to accept these Terms for that organization.

GoldenCircle is a relationship system that lets you save people, keep notes and context about them, transcribe conversations, search your information, and use AI playbooks to decide what to do next. We may add, change, or remove features over time as the Service evolves.

You are responsible for the activity that happens under your account and for keeping your access secure. Sign-in is handled through our authentication provider. You agree to provide accurate information and to let us know promptly if you believe your account has been accessed without your permission.

GoldenCircle offers free and paid plans. Paid subscriptions are billed through Stripe on a recurring basis (for example, monthly or yearly) until cancelled. We may offer a free trial; unless you cancel before the trial ends, your plan will convert to a paid subscription and your payment method will be charged.

You can cancel at any time, and cancellation takes effect at the end of your current billing period. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. We may change our prices, and we will give you reasonable notice before a price change affects you.

Paid plans and certain features are subject to usage limits, including limits on AI requests and transcription. We may enforce these limits and adjust them over time.

You agree not to use the Service to:

• Break the law, infringe the rights of others, or violate any person’s privacy.
• Store or share information you are not allowed to keep, or use the Service to harass, stalk, or harm anyone.
• Upload malicious code, attempt to gain unauthorized access, or interfere with or disrupt the Service.
• Reverse engineer, scrape, or copy the Service except as allowed by law.
• Resell or commercially exploit the Service without our permission.
• Use the Service to send spam or unsolicited messages.

You keep ownership of the content you add to GoldenCircle, including people, notes, and conversations (your Content). You grant us a limited license to host, store, process, and transmit your Content as needed to operate and provide the Service to you, including sending relevant content to the service providers described in our Privacy Policy.

Because the Service is designed to store information about other people, you are solely responsible for the information you record about others. You represent that you have the right to collect and store that information and that doing so complies with applicable laws. You agree to respect the privacy of the people you record and to remove their information if they ask you to. You are responsible for your Content and the consequences of storing and sharing it.

AI features generate responses automatically and can be inaccurate, incomplete, or out of date. You are responsible for reviewing AI output before relying on or acting on it. GoldenCircle does not provide legal, financial, medical, or other professional advice, and AI output is not a substitute for advice from a qualified professional.

The Service, including its software, design, and branding, is owned by GoldenCircle and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. These Terms do not give you any right to our trademarks or logos.

The Service relies on third-party providers, such as authentication, AI, transcription, payment, and storage services. Your use of the Service may also be subject to those providers’ terms. We are not responsible for third-party services, and their availability is not guaranteed.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service. When your account ends, your right to use the Service stops, and we will handle your data as described in our Privacy Policy.

The Service is provided on an as is and as available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content or AI output will be accurate.

To the maximum extent permitted by law, GoldenCircle and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

You agree to indemnify and hold GoldenCircle harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or the rights of any third party.

These Terms are governed by the laws of the jurisdiction in which GoldenCircle is established, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
